Abstract Paragraph 1 of section 29 of the Italian Constitution ("The Republic
recognises the rights of the family as a natural society founded on
marriage") is famous for being contradictory and for some time has been the subject of legal and political debates.  
The origin of section 29 will be reconstructed in this essay by analysing the debate of the Constituent Assembly (1946-1947): it will be shown how the expression “founded on marriage” derives from  the amalgamation of two sections (one on family and one on marriage) which had always been conceived as two separate items, even by the catholic Members of Parliament. This amalgamation stemmed from  the fight about introducing a ban on divorce into
the Constitution and the resulting failure to do so left the first paragraph incomplete and incomprehensible. The research highlights not only the difficulty  of the DC (Christian Democrat Party) and the PCI (Italian Communist Party) to reach the customary constitutional compromise on family issues but also the divisions within the individual parties and the conditioning force exerted by the propagandistic  strategies in view of the 1948 elections.
